PRIVACY NOTICE

1. PURPOSE

1.1. The purpose of this Notice is to confirm Interactive Credit Solutions (Pty) Ltd’s commitment to ensure your Personal Information is handled in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA).

1.2. POPIA states that Personal Information must be:

1.2.1. Used lawfully, in a reasonable manner, and in a transparent way.

1.2.2. Collected only for a specific purpose that is clearly explained and not used in a way that is incompatible with its purposes.

1.2.3. Relevant to the purposes and limited only to those purposes.

1.2.4. Complete, accurate, and kept up to date.

1.2.5. Kept only for as long as necessary for its purpose.

2. DEFINITIONS

2.1. “Cookie/s” (also called web cookie, Internet cookie, browser cookie, or simply cookie) is a small piece of data sent from a website and stored on the user’s computer by the user’s web browser while the user is browsing to inter alia remember stateful information (such as items added in the shopping cart in an online store) or to record the user’s browsing activity.

2.2. “Data subject” means the person to whom Personal information relates.

2.3. “Information officer” means the person appointed by Interactive Credit Solutions (Pty) Ltd, from time to time, who is responsible for the monitoring of compliance, by Interactive Credit Solutions (Pty)Ltd, with the conditions for the lawful processing of Personal information; dealing with requests made to Interactive Credit Solutions (Pty) Ltd in terms of the POPIA; working with the Regulator in relation to investigations conducted in relation to prior authorisation by the Data subject and ensuring compliance by Interactive Credit Solutions (Pty) Ltd with the provisions of the POPIA

2.4. “Person” means any person, company, close corporation, trust, partnership, or other entity.

2.5. “Personal information” means information relating to an identifiable, living, natural person, and where it is applicable, an identifiable, existing juristic person, including, but not limited to—

2.5.1. information relating to the race, gender, sex, pregnancy, marital status, national, ethnic, or social origin, colour, sexual orientation, age, physical or mental health, well-being, disability, religion, conscience, belief, culture, language, and birth of the person.

2.5.2. information relating to the educational, medical, financial, criminal, or employment history of the person.

2.5.3. any identifying number, symbol, e-mail address, physical address, telephone number, location information, online identifier, or other particular assignment to the person.

2.5.4. the biometric information of the person; and/or

2.5.5. the personal opinions, views, or preferences of the person.

2.5.6. correspondence sent by the person that is implicitly or explicitly of a private or confidential nature or further correspondence that would reveal the contents of the original correspondence.

2.6. “Privacy Notice or Notice” means this Notice as amended from time to time.

2.7. “Processing” means any operation or activity or any set of operations, whether or not by automatic means, concerning Personal Information, including—

2.7.1. the collection, receipt, recording, organisation, collation, storage, updating or modification, retrieval, alteration, consultation, or use.

2.7.2. dissemination by means of transmission, distribution or making available in any other form; or

2.7.3. merging, linking, as well as restriction, degradation, erasure, or destruction of information.

3. HOW AND WHY DOES INTERACTIVE CREDIT SOLUTIONS (PTY) LTD COLLECT YOUR INFORMATION?

3.1. During the execution of our events and services, Interactive Credit Solutions (Pty) Ltd will require you to complete our contact enquiry forms in which we will collect Personal Information directly from you, including your name, contact details such as e-mail addresses and cell phone numbers, your Identity number, and any other information required for utilising the service of Interactive Credit Solutions (Pty) Ltd

3.2. Interactive Credit Solutions (Pty) Ltd will retain Personal Information obtained from electronic or physical forms of communication from you, including e-mails, telephonic calls, SMS’s, social media, and instant messaging.

3.3. Interactive Credit Solutions (Pty)Ltd will receive Information about you via governmental departments and agencies for marketing events, shows, and exhibitions from time to time. This is detailed further below.

3.4. We use your Personal Information received from you to provide you with our services and inform you of other related Interactive Credit Solutions (Pty) Ltd services, shows, exhibitions, and engagements that may be suitable for your needs. You may ask us to stop sending you marketing information about Interactive Credit Solutions (Pty)Ltd services, shows, exhibitions, and engagements at any time by calling or sending an e-mail to info@icscredit.co.za

4. SERVICES PROVIDERS OF INTERACTIVE CREDIT SOLUTIONS (PTY)LTD

4.1. When you apply to provide Interactive Credit Solutions (Pty) Ltd with your services, we collect your Personal Information directly from you.

4.2. We may also collect your credit score and credit report from credit bureaus and Information about your financial position from your credit providers and their representatives.

5. WEBSITE

5.1. We may collect Information about you from our website via technical means such as cookies, webpage counters, and other analytics tools. We use this Information to manage, report, and ensure our website operates effectively and securely.

5.2. From time to time, our website may contain links to third-party websites, plug-ins, and applications. Clicking on those links or enabling those connections may allow third parties to collect or share data about you. We do not control these third-party websites and are not responsible for their privacy measures. When you leave our website, we encourage you to read the privacy notice of every website you visit.

5.3. Our website contains contact forms where you provide your Personal information in order to download content or raise queries with us. We keep this data in our web database for a limited period.

6. COOKIES

6.1. We collect certain Information automatically by using cookies when you visit our website. This Information includes your device operating system, access times, location, and use of the website.

6.2. We use this Information to improve the way our website functions to provide a better service.

7. THIRD PARTIES

7.1. We may receive Information about you from the following sources:

7.1.1. Our service providers: We work closely with third parties (including marketing firms) who may provide us with Information about you to be used as set out above.

7.1.2. Our other channels: This is Information we receive about you if you use our website, other departments, or services we provide, and/or we are involved in. In this case, we will inform you when we are collecting the Personal Information if we intend to process that information collected.

7.2. If you have filled in an online survey for our benefit, we may keep this data for statistical purposes.

7.3. We ensure that any disclosure of your Information is done so in accordance with POPIA.

8. INFORMATION SECURITY

8.1. We have sufficient measures in place to provide for appropriate internal security measures to prevent your Personal Information from being accidentally lost, used, or accessed in an unauthorised way or from being altered or disclosed.

8.2. We have put in place procedures to deal with any suspected data security breaches and will notify you, together with the Regulator, of a suspected breach where necessary.

9. HOW LONG DO WE KEEP YOUR INFORMATION FOR?

9.1. We keep your Information for up to 5 (five) years upon completing the purpose for which it was collected or as required legal obligation.

9.2. To determine the appropriate retention period for Personal Information, we consider the amount, nature, and sensitivity of the Personal Information, the potential risk of harm from unauthorised use or disclosure of your Personal Information, the purposes for which we process your Personal Information and whether we can achieve those purposes through other means.

9.3. In some circumstances, we may anonymise your Personal Information to no longer be associated with you, in which case we may use such Information without further Notice to you.

10. MARKETING

10.1. We may collect your name and contact details (such as your e-mail address, phone number, or address) to send you Information about our products and services that might interest you. We may collect this directly from you or through a third party.

10.2. You always have the right to “opt-out” of receiving our marketing. You can exercise the right at any time by contacting us at info@icscredit.co.za

10.3. If we send you any marketing e-mails, we will provide an unsubscribe option to opt out of any further marketing e-mails.

10.4. We will not share your name or contact details with third parties for marketing purposes unless we receive your consent.

10.5. We retain your details on our marketing list until you “opt-out”, at which point we take your details off our contract list and database.

10.6. We keep that suppression list indefinitely to comply with our legal obligations to ensure we do not accidentally send you any more marketing.

11. DATA SUBJECT PARTICIPATION REQUEST

11.1. Interactive Credit Solutions (Pty)Ltd provides for the right for data subjects to view their Personal Information, as and request copies of the data, and

11.2. The Data subject requests must be made in writing. Verbal requests for correction, deletion, or destruction of the Information held about an individual are not a valid request.

11.3. If a formal request is made verbally to a staff member of Interactive Credit Solutions (Pty) Ltd, a written request must be requested. A request can be made via any of the following methods: e-mail to info@icscredit.co.za or at our offices. Interactive Credit Solutions (Pty) Ltd will not provide Personal Information via social media channels.

12. YOUR RIGHTS

12.1. POPIA gives you a number of rights when it comes to the Personal Information, we hold about you. The fundamental rights are set out below. Under certain circumstances, by law, you have the right to:

12.1.1. ask what Personal Information we have about you.

12.1.2. ask what Personal Information we sent to our suppliers, service providers, or anyone else.

12.1.3. ask us to update, correct, or delete any out-of-date or incorrect Personal Information we have about you.

12.1.4. unsubscribe from any direct marketing communications we may send you,

12.1.5. object to the processing of your Personal Information; and

12.1.6. lodge a complaint about our practices with the Information Regulator.

12.2. We will respond to your request as soon as reasonably possible, but this process may take up to 21 (twenty-one) days, depending on the complexity of the request.

12.3. We require you to submit a written POPIA Complaint Form to the Information Officer via info@icscredit.co.za

12.4. Upon completion of an investigation of the complaint, the Information Officer will either:

12.4.1. A suggested remedy for the complaint; or

12.4.2. Dismiss the complaint with reasons as to why it was dismissed; or

12.4.3. Tender an apology and any disciplinary action that has been taken against any employee involved.

12.5. In some instances, we may need proof of your identity, and sometimes we may have additional requirements before we can update your Information.

12.6. Should you as the data subject not be satisfied with the outcomes of the Information Officer’s conclusion, you do have the right to complain to the Information Regulator.

13.1. This notice was last updated on 01 July 2021.

13.2. Any changes we make to our privacy notice in the future will be posted on this page and, where appropriate, notified to you by e-mail or otherwise.
